These Terms & Conditions govern your access to and use of the JhaskCom wholesale fashion platform, including all associated websites, mobile experiences, APIs, and services. By creating an account, placing an order, or using our platform in any way, you agree to be legally bound by these terms. If you do not agree, please discontinue use immediately.
Acceptance of Terms
Agreement to Terms
By accessing or using JhaskCom's platform (website, app, or any related service), you confirm that you are at least 18 years of age and have the legal authority to enter into a binding agreement. If you are accessing on behalf of a business entity, you confirm you are authorised to bind that entity.
Wholesale Platform
JhaskCom is a B2B wholesale fashion platform. Our services are intended for registered businesses, retailers, boutique owners, and approved resellers. Consumer use is subject to applicable terms. We reserve the right to verify business credentials before order processing.
Account & Registration
Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials. Any activity under your account is your responsibility. Notify us immediately at support@jhaskcom.com if you suspect unauthorised access.
Accurate Information
You agree to provide accurate, current, and complete information during registration and order placement. This includes valid GST numbers, business addresses, and contact details. Providing false information may result in account suspension.
Account Termination
JhaskCom reserves the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or abuse our platform, with or without prior notice.
Ordering & Payment
Order Confirmation
All orders are subject to availability and acceptance by JhaskCom. An order confirmation email does not constitute final acceptance — orders may be cancelled if stock is unavailable or payment is declined. Final acceptance occurs upon dispatch confirmation.
Minimum Order Quantity (MOQ)
Wholesale orders are subject to applicable MOQ requirements as specified on product listings. MOQs are set by individual brands and may vary. Failure to meet MOQ may result in order modification or cancellation.
Pricing & GST
All prices displayed are exclusive of GST unless stated otherwise. GST will be applied at the applicable rate at checkout. Prices are subject to change without notice. GST-compliant invoices will be issued for every order.
Payment Terms
Payments must be made at the time of order placement unless credit terms have been pre-approved in writing. We accept UPI, NEFT/RTGS, debit/credit cards, and approved credit facilities. Delayed payments may attract late fees.
Intellectual Property
Ownership
All content on the JhaskCom platform — including product images, descriptions, brand assets, logos, designs, and software — is the intellectual property of JhaskCom or its licensors. All rights are reserved.
Permitted Use
Registered resellers and retailers may use product images and descriptions solely for the purpose of reselling JhaskCom products through authorised channels. Any other use, reproduction, or distribution requires prior written consent from JhaskCom.
Restrictions
You may not reverse engineer, scrape, copy, modify, or create derivative works from any part of our platform without explicit written permission. Violation may result in legal action.
Prohibited Conduct
Prohibited Activities
You agree not to: (a) use the platform for any unlawful purpose; (b) infringe upon the intellectual property rights of JhaskCom or third parties; (c) attempt to gain unauthorised access to any system or data; (d) post false or misleading information; (e) use automated tools to scrape or harvest data; (f) engage in resale to blacklisted entities or jurisdictions.
Brand Misrepresentation
You must not misrepresent your affiliation with JhaskCom or its brands. Use of JhaskCom trademarks without explicit written permission is prohibited.
Limitation of Liability
No Warranty
Our platform and products are provided "as is." We do not warrant that the platform will be error-free, uninterrupted, or free from viruses. To the fullest extent permitted by law, JhaskCom disclaims all warranties, express or implied.
Liability Cap
JhaskCom's aggregate liability for any claims arising from use of our platform or products shall not exceed the total amount paid by you for the specific order giving rise to the claim, in the 6 months preceding the event.
Consequential Damages
JhaskCom shall not be liable for indirect, incidental, punitive, or consequential damages, including lost profits, loss of goodwill, or data loss arising from your use of our services.
Governing Law & Disputes
Jurisdiction
These Terms & Conditions are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Jaipur, Rajasthan.
Dispute Resolution
In the event of a dispute, both parties agree to attempt resolution through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to arbitration under the Arbitration and Conciliation Act, 1996.
Related Policies
JhaskCom reserves the right to modify these Terms at any time. Continued use of our platform after changes are posted constitutes your acceptance of the revised Terms.
